Amendments to the New Taxation

The deadline for submitting amendments to the Gambling Taxation Act under discussion ended 12th September. To date, we have registered 33 submitted amendments to the entire tax package. Of the 33 amendments submitted, 15 propose changes in taxation of winnings or taxation of operators. They are listed at the beginning of the document attached (in Czech only).

Below is a short summary:

Taxation of winnings

  • It is great to see that 3 amendments submitted propose a complete abolition of the winnings tax. We were very pleased that these submissions are based on the arguments and evidence supplied by IFGR and some of them even refer directly to our materials.
  • In addition, several submissions substantially increase the limit for the winnings tax exemption from the proposed CZK 100,000 to CZK 1 million or even up to CZK 10 million.
  • There is also the previously announced submission of the Ministry of Finance, which keeps the withholding tax for lottery and introduces the income tax paid by a player for all other games.

Taxation of operators

  • There are submissions to raise the tax on technical games to 38% and even 40%.
  • There are also amendments that, compared to the original draft, reduce the tax rate for lotteries, fixed-odds betting and totalisator games from 25% to 23%.
  • There are also amendments regulating the taxation of live games from 30% to 25% or proposing a special poker rate of 25%, while the originally proposed rate of 30% would apply to the other live games.
  • There is also an amendment, which cancels the entire intended tax increase for all types of gambling games.
